Wills and Probate Lawyers Sydney

Wills, probate and estates.
Handled with care.

Wills, probate, powers of attorney and enduring guardianship. A clear will while you can make one. No jargon, no unnecessary complication, and a fee you know up front.

We help you put a clear will in place, obtain probate and administer estates with care and sensitivity. If you do not have someone suitable to take on the responsibility, you can also appoint one of our solicitors as your executor.

We keep the process straightforward, explain things in plain English and give you clear information about fees from the outset.

Dealing with an estate after someone has died can feel overwhelming. We explain what needs to happen, what comes next and the order each step should be taken in, so you always know where the matter stands.

What we help with

Wills

Simple or complex. Drafted clearly so your wishes are understood and your will works as intended when it is needed.

Powers of attorney and enduring guardianship

Choosing who can make financial, personal and lifestyle decisions for you if you are no longer able to make them yourself.

Probate applications

Applying to the Supreme Court of New South Wales for a grant of probate so the executor can administer the estate.

Estate administration

Collecting assets, paying debts and expenses, dealing with institutions and distributing the estate properly and in the right order.

How we work

Plain language.

You should understand your own will. If you do not, we have not done our job.

A fee you know up front.

Especially for a straightforward will, where there is no reason for the cost to come as a surprise.

We take care of the administration.

An estate involves a lot of paperwork and chasing. We handle that so it is not something you have to manage alone while you are grieving.

We tell you what happens next.

At every stage, in the right order, so you know where the estate stands and what to expect.

Common questions

The estate is distributed according to the rules of intestacy under New South Wales law, rather than according to the person’s wishes. Who receives the estate depends on the family members they leave behind. If you are dealing with an estate where there is no will, we can tell you who is entitled and what needs to happen next.

Not always. It depends on the assets in the estate, how they are owned and the requirements of the institutions holding them. Some estates can be dealt with without probate. Tell us what the estate consists of and we will tell you whether an application is needed.

There is no single timeframe. It depends on the estate, whether the application is straightforward and whether the Court raises any issues that need answering. We give you a realistic indication at the outset and keep you informed as the application progresses.

An executor is responsible for administering the estate. That can include identifying and protecting assets, applying for probate where required, paying debts and expenses, dealing with institutions and ultimately distributing the estate to the beneficiaries. We can handle the legal and administrative work with you.

For a straightforward will we can give you a fixed price up front. More complex estate planning may need a proper review first, but you will know the cost before we start.

Often, yes. If a will, grant of probate or other document needs to be certified, witnessed or authenticated for use overseas, we can help as a public notary. See our notary public services.
